Welcome to myBarber! These Terms of Use ("Terms") govern your access to and use of the myBarber mobile application and services provided by Todak Holdings Sdn Bhd ("myBarber"). By accessing or using the myBarber platform, the Customer (“you”) agree to be bound by these Terms.
1. Acceptance of Terms
1.1 Agreement to Terms
By accessing or using the myBarber platform, You agree to be bound by these Terms and our Privacy Policy. If You do not agree to these Terms, You may not use the platform.
1.2 Modifications
myBarber reserves the right to modify these Terms at any time. Notice of modifications shall be provided via email or through the platform. Continued use of the platform after such modifications constitutes acceptance of the new Terms.
2. Eligibility
2.1 Requirements
To use the myBarber platform, You must be at least 18 years old or have parental consent if you are under 18.
3. Account Registration
3.1 Account Creation
You must create an account on the myBarber platform by providing accurate and complete information.
3.2 Account Security
You shall be responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3 Profile Information
You shall keep your profile information up-to-date, including your contact information and payment details.
4. Use of the Platform
4.1 Permitted Use
You shall use the myBarber platform to book hair grooming services from barbers listed on the platform.
4.2 Prohibited Use
You shall not use the platform for any unlawful purposes or in a way that could damage, disable, overburden, or impair the platform.
4.3 Compliance
You shall comply with all applicable laws, regulations, and industry standards while using the platform.
5. Booking and Payments
5.1 Booking Process
Youmay book services through the myBarber platform. The confirmation regarding your booking shall be received through the app
5.2 Payment Terms
Payment for services booked through the platform must be made through the myBarber payment gateway (BillPliz). You shall agree to pay all fees and charges associated with your bookings.
5.3 Service Fees
myBarber shall charges a service fee for each booking, which is included in the total price displayed at the time of booking.
6. Cancellations and Refunds
6.1 Non-Cancellation Policy
Once a booking is confirmed, it shall not be canceled by either party except under exceptional circumstances.
6.2 Exceptional Circumstances
In cases of emergencies or technical issues, you may contact myBarber support for assistance.
6.3 Refund Processing
Refunds will be processed within 5-10 business days and issued to the original payment method used at the time of booking.
7. Support and Communication
7.1 Support Channels

7.2 Response Time
myBarber aims to respond to support requests within specified timeframes, as detailed on the platform.
8. Reviews and Ratings
8.1 Leaving Reviews
After receiving a service, you may leave a review and rating for the barber. Your feedback must be honest and respectful.
8.2 Content Guidelines
Reviews shall not contain any offensive, defamatory, or inappropriate content. myBarber reserves the right to remove reviews that violate these guidelines.
9. Confidentiality and Privacy
9.1 Confidential Information
You shall agree to keep confidential any proprietary information and trade secrets of myBarber.
9.2 Privacy Policy
Your use of the platform is subject to myBarber’s Privacy Policy, which outlines how personal data is collected, used, and protected.
10. Intellectual Property
10.1 Ownership
myBarber owns all rights, title, and interest in and to the platform, including all intellectual property rights.
10.2 License
myBarber grants You a limited, non-exclusive, non-transferable license to use the platform in accordance with these Terms.
11. Termination
11.1 Termination by Customer
You may terminate your account with [X] days' written notice to myBarber.
Step 1: Initiate Termination Request
Customer Action: To terminate your account, log in to the myBarber app and navigate to the "Account Settings" section.
In-App Process: Select "Terminate Account" and follow the prompts to submit your termination request.
Step 2: Confirmation of Termination Request
myBarber Action: Upon submission of your request, myBarber will send an in-app notification and an email confirmation acknowledging receipt of your termination request.
Step 3: Account Deactivation
myBarber Action: Your account will be scheduled for deactivation. You will receive a final confirmation once the deactivation is complete.
Customer Action: Ensure you have saved or recorded any necessary information from your account before it is deactivated, as access will be permanently revoked.
Step 4: Final Settlement
myBarber Action: Any pending transactions or refunds will be processed prior to deactivation. myBarber will ensure all financial matters are settled.
Step 5: Data Retention and Deletion
myBarber Action: myBarber will retain necessary personal information to comply with legal obligations, resolve disputes, and enforce agreements. Non-essential data will be deleted or anonymized according to our Privacy Policy.
11.2 Termination by myBarber
myBarber may terminate your account immediately for cause if you breach any terms of this Agreement.
11.3 Effect of Termination
Upon termination, your access to the platform shall be revoked.
12. Limitation of Liability
12.1 No Liability for Services
myBarber shall not be liable for any issues arising from the services provided by barbers to customers.
12.2 Platform Availability
myBarber does not guarantee continuous, uninterrupted access to the platform and is not liable for any downtime or technical issues.
13. Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia.
13.2 Arbitration
Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the Asian International Arbitration Centre (AIAC) in Kuala Lumpur.
14. Miscellaneous
14.1 Entire Agreement
These Terms constitute the entire agreement between myBarber and the Customer
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
14.3 Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term.
